Terms of Service

Qwkroute is an AI-powered gig economy optimization platform that provides data-driven insights and recommendations to independent gig workers. Our Service includes:

• AI-powered shift planning that recommends when, where, and on which platform to work
• Real-time demand heatmaps showing activity across gig platforms such as DoorDash, Uber, Lyft, Instacart, and GrubHub
• Earnings analytics with per-platform, per-zone, and per-hour breakdowns
• Integration with third-party gig platforms for data aggregation and analysis

Qwkroute is an informational and analytical tool only. We do not guarantee any specific level of earnings or outcomes. All recommendations are based on historical data and predictive models and should be used at your own discretion.

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these Terms.

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select
• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
• Refunds are not provided for partial billing periods; upon cancellation, you retain access to paid features until the end of the current billing period
• We reserve the right to change subscription pricing with at least 30 days' notice before the change takes effect

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to gain unauthorized access to, interfere with, or disrupt any part of the Service, its servers, or any connected networks
• Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or its AI models
• Share, resell, or redistribute your account credentials or access to the Service with any third party
• Use the data or insights provided by the Service to build a competing product or service
• Transmit any viruses, malware, or other harmful code through the Service
• Misrepresent your identity or affiliation with any person or entity

The Service and its entire contents, features, and functionality -- including but not limited to all information, software, code, algorithms, AI models, text, displays, images, graphics, and design -- are owned by Qwkroute, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use in connection with your gig work activities. This license does not include the right to sublicense, modify, adapt, translate, reverse engineer, decompile, or disassemble any aspect of the Service.

The Qwkroute name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Qwkroute. You may not use such marks without our prior written permission.

You retain ownership of any data you provide to the Service, including earnings data imported from connected gig platforms. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze your data solely for the purposes of providing and improving the Service.

We may use aggregated, de-identified data derived from your usage to improve our recommendation engine, generate market insights, and enhance the Service. Such aggregated data will not identify you personally.

The Service integrates with third-party gig economy platforms including, but not limited to, DoorDash, Uber, Lyft, Instacart, and GrubHub. Qwkroute is not affiliated with, endorsed by, or sponsored by any of these platforms. All third-party platform names and trademarks are the property of their respective owners.

Your use of any third-party platform is governed by that platform's own terms of service and privacy policy. We are not responsible for the content, policies, or practices of any third-party platform. You are solely responsible for ensuring that your use of the Service complies with the terms of any third-party platform you use.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Qwkroute does not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any information, data, or recommendations provided through the Service. Earnings estimates, demand predictions, and shift recommendations are based on historical data and predictive models and are provided for informational purposes only.

You acknowledge that gig economy earnings are inherently variable and depend on many factors outside our control, including but not limited to weather, local events, platform policies, competition, and individual performance.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QWKROUTE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability or (b) one hundred dollars ($100).

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You may request a copy of your data within 30 days of termination by contacting qwkroute@gmail.com
• We may delete your account data after the 30-day period
• All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate your account at any time by contacting us at qwkroute@gmail.com or through the account settings in the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware. Each party shall bear its own costs of arbitration, and the arbitrator's award shall be final and binding.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Qwkroute each waive any right to a jury trial.

Demand predictions, surge forecasts, and shift recommendations provided by Qwkroute are generated using artificial intelligence and historical data analysis. These are estimates only and are NOT guarantees of actual demand, earnings, or surge pricing.

Actual earnings depend on many factors outside our control including but not limited to: real-time market conditions, driver supply, customer behavior, platform algorithms, traffic, and weather. Users should exercise independent judgment when making decisions based on Qwkroute's recommendations.

Paid subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged at the then-current subscription price.

You can manage or cancel your subscription through your account settings or the Stripe Customer Portal. If you subscribed through the Apple App Store or Google Play Store, you must cancel through the respective store's subscription management.
