These Terms of Service (the "Terms") govern your access to and use of the Qwkroute website at qwkroute.com and any associated mobile applications (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
"Qwkroute," "we," "our," and "us" refer to the operators of the Service. "You" and "your" refer to the individual or entity using the Service. "Account" refers to your registered user account.
Eligibility
- You must be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher.
- You must be legally able to enter into a binding contract under the laws of your jurisdiction.
- You must not be barred from using the Service under the laws of the United States or the jurisdiction in which you reside.
- Each account is for a single individual. Sharing an account is a material breach of these Terms.
Nature of the service
Qwkroute is a software tool that helps gig-economy drivers plan shifts, analyze earnings, track demand patterns, and make informed decisions about when and where to work. Qwkroute is a productivity and analytics tool.
Qwkroute is not a gig-work platform. We do not employ drivers. We do not offer or dispatch work. We do not pay drivers. We are not a party to any relationship between you and any third-party platform (such as DoorDash, Uber, Lyft, Instacart, or GrubHub). Qwkroute has no affiliation with and is not sponsored or endorsed by any gig-work platform. All platform names appearing in the Service are the trademarks of their respective owners and are used only to identify the platform you have selected in your own settings.
Your account
- You are responsible for the accuracy of the information you provide during registration.
- You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us immediately at the email in Section 14 if you suspect unauthorized access.
- You agree to receive service-related communications by email, including security alerts, password resets, and billing notices. You may opt out of optional marketing communications from within the Service; you cannot opt out of essential transactional communications.
Acceptable use
You agree not to, and not to permit any third party to:
- Use the Service for any purpose that is unlawful, infringing, fraudulent, or harmful.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by applicable law.
- Scrape, harvest, or otherwise collect data from the Service by automated means, except through officially documented data export features.
- Interfere with or disrupt the Service, including by attempting to bypass rate limits, authentication, or security controls.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Submit false, misleading, or manipulated shift data with the intent to distort community statistics or mislead other users.
- Resell, sublicense, or provide the Service to third parties as a standalone offering.
- Use the Service in violation of the terms of service of any third-party platform you participate in as a driver.
Subscriptions, billing, and refunds
Paid tiers
Qwkroute offers an optional paid subscription (Premium and Pro). Current pricing is displayed on the pricing page. Prices may change on renewal with at least thirty (30) days' notice to existing subscribers.
Billing
Subscriptions are billed in advance on a monthly or annual cycle depending on the plan you select. Payments are processed by Stripe, Inc. You authorize Qwkroute, through Stripe, to charge your payment method at the beginning of each billing cycle until you cancel.
Cancellation
You may cancel your subscription at any time from account settings or by contacting us. Cancellation takes effect at the end of the current billing period. You retain access to paid features through the end of the period you have already paid for.
Refunds
All payments are final and non-refundable except where required by applicable consumer-protection law, or at our discretion in exceptional circumstances. If you believe you are entitled to a refund, email us at the address in Section 14.
Free tier
A free tier is provided at our discretion. We may modify free-tier features or limits with reasonable notice. We will not revoke the free tier retroactively for active users without at least thirty (30) days' notice.
Intellectual property
Qwkroute and its licensors own all right, title, and interest in and to the Service, including all software, designs, logos, and trademarks associated with the brand. You receive no ownership rights by using the Service; we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose during the period your account is active.
You retain ownership of the content you submit (shift logs, notes, vehicle settings, goals). You grant Qwkroute a worldwide, royalty-free license to use that content solely to provide the Service to you and to compute anonymized aggregate statistics as described in our Privacy Policy. We do not claim ownership of your content.
Third-party services and integrations
The Service integrates with third-party services (Stripe for payments, Mapbox for map data, Ticketmaster for event data, and others listed in the Privacy Policy). Your use of those third-party services is subject to the third party's own terms. We are not responsible for third-party services, their availability, or the accuracy of data they provide.
Accuracy of information
Qwkroute presents predictions, recommendations, statistics, and estimates generated from a combination of public data, user-submitted data, and machine-learning models. These outputs are provided for informational purposes only. They are not guarantees of earnings, demand levels, or driver safety. You are solely responsible for your decisions about when, where, and whether to drive.
Earnings forecasts are estimates. Shift plans are suggestions. Map data may be incomplete. We make no representation that the Service will cause you to earn more or less than you would without it.
Warranty disclaimer
The service is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Qwkroute does not warrant that the Service will be uninterrupted, error-free, or secure; that defects will be corrected; or that the Service or the servers that make it available are free from harmful components.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Qwkroute, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of earnings, loss of data, or loss of goodwill, arising out of or in connection with your use of or inability to use the service.
Qwkroute's aggregate liability for any claim arising out of or relating to these terms or the service shall not exceed the greater of one hundred United States dollars (US$100) or the amount you have paid Qwkroute in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In those jurisdictions, the limitations in this section apply only to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Qwkroute and its officers, directors, employees, and agents from any claim, demand, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any applicable law or the rights of any third party.
Termination
You may close your account at any time by using the delete function in account settings or by emailing us at the address in Section 14.
We may suspend or terminate your account for any material breach of these Terms, for conduct that we reasonably believe is unlawful or harmful, for extended inactivity, or for operational reasons. If we terminate without cause we will provide a prorated refund of any prepaid subscription fees for the unused portion of the current billing period. Sections that by their nature should survive termination (including intellectual property, warranty disclaimer, limitation of liability, indemnification, and dispute resolution) will survive.
Governing law and dispute resolution
Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution
Before filing any formal claim, you agree to first contact us at the email in Section 14 and describe the dispute. We will attempt in good faith to resolve the dispute informally within thirty (30) days.
Venue
If informal resolution fails, any legal action arising out of or relating to these Terms shall be filed exclusively in the state or federal courts located in Shelby County, Tennessee, and you consent to the personal jurisdiction of those courts. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
Class action waiver
To the extent permitted by applicable law, any dispute shall be resolved on an individual basis. You and Qwkroute waive the right to participate in a class action, collective action, or representative proceeding.

We may update these Terms from time to time. If we make a material change, we will notify registered users by email at least fourteen (14) days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to a revised version, you must stop using the Service and may delete your account before the effective date.
Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Qwkroute regarding the Service.
- Severability. If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
- No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
- Headings. Section headings are for convenience only and do not affect interpretation.
